USS T-Durant Mission TDRP16070: "Plausible Deniability" (181107)

The USS Taylorholic Durant is considered to be the Flagship of the UFS Fleet. We are honoured to have Admiral Mike Calhoun as our former CO and as a current crew member, as well as other luminaries. We support UFSA as much as we can and we provide mentorship to the JOOP & CGSD graduate programs.
We roleplay in-world on a drop-in and scheduled basis. We also add to our history and environment by writing RP Narratives, Mission Logs & Personal Stories for the UFS forum.
Inspired by the ship's namesake, the late Admiral Taylorholic Durant, crew members work to exemplify the behaviour, actions & vision of United Federation Starfleet in everything they do. Our first rule: to be kind to one another. And have fun.

Captain's Log, Stardate 181107.113: I remain involved in negotiations on S'Raris Station. I shall need to write a detailed log but for the moment I have informed Starfleet Command that the talks are going well and we may soon have a peace treaty for the area.

I was rather astonished to read the reports from Chief Science Officer Rieko with regard to the situation at Alabaster Mining Colony. Much must be done to return the mining area of the planet back to it's normal state. The finding of an artifact of such importance as to show life once existed on the planet - and perhaps still does in some manner undetectable by us - the miners lack of responsibility in neglecting to report this is very much against Starfleet policy. I believe the plan is to remove all technology and traces of our presence there and place a restrictive buoy nearby to ask the planet not be approached. Whatever life exists there must be allowed to develop on its own and without any interference from us. That is the Prime Directive and I am sure the mining consortium knew the regulations.

The Durant has Mr Harley Gresham, Shift Mine Foreman, and Ms Katarina McKenzie, Alabaster Mine Director, in the brig, the rest of their mining crew have been confined to quarters pending further questioning. Durant Senior officers report that an interrogation of McKenzie and Gresham is scheduled for 1145 hours in the briefing room. Durant has sensor readings and tricorder data as well as the evidence seen by the Away Team. I hope the interrogators will get further information from these two with regard to their activities, their violation of Federation Law, and the whereabouts of the two missing miners.

RP NARRATIVE

Rhys Careli Axel walks into the briefing room and sits down in front of the miners looking at them and giving them a nod one at a time. "Greetings. And I hope you all know why you are here by now?"

Katarina McKenzie looks at the group and nods back to the new face coming in and then whispers to Harley "I can't believe we're being treated like this! I never knew what a 'brig' looked like but it really does need an interior decorator badly! And do not start me on the 'food'! How do people live on that! I'm just glad we've got some help in this I was really starting to get worried how fast this seemed to get out of control, but our other 'partners' said they would get the best help available and this guy comes highly recommended so at least we're not in this on our own anymore!" Wriggles in her seat trying to get comfortable feeling nervous.

Nems Johari strides his tired body into the briefing room, thinking to himself this best be good, was catching some sleep before going back on duty. Takes a seat seeing the two crewman from the mining just shaking my head knowing they are in trouble. Looks across from me seeing an unfamiliar odd person that he does not know.

Droikor: Greetings all! Please allow me to introduce myself, my name is Droitkor and I am one of the partners at Frakit & Darnit the leading commercial and litigation specialists in the entire galaxy" straightens his jacket with a satisfied grunt and a wave of his hand "I'm sure some of you will have heard of us, anyway. I am here representing my clients Ms Katarina McKenzie and Mr Harley Gresham, who I will start off reminding everyone here!" pauses to allow that to sink in and for dramatic effect as he scowls at the room like a teacher chastising a class "I shall remind you ALL ….that neither Ms McKenzie or Mr Gresham ….are members of your military or even in this quadrant subject to your 'Federation' laws. I find myself feeling I also need to point out that we are not in Federation territory here and your jurisdiction is not established on Tcatn V!" Smiles warmly at Ms McKenzie and Mr Gresham placing a comforting hand over each before looking directly at the 'interrogators' and in a loud brash tone addresses them formally "Therefore we can proceed with whatever charade you feel you need to before releasing my clients but I will not allow my clients to compromise their interests during this irrelevancy in any way whatsoever." Sits back and taps into his PADD "Oh yes and I am recording this meeting, just so you are aware, you have been so advised."

Pleasure Hopkins looks at the three across the table, looking for signs of nervousness, where their eyes fall, how long they hesitate before speaking. Her time spent at the Academy had prepared her, in simulations, but not for this, a real life situation! "I do hope you all have been comfortable. There will be many questions for all of you, and I do hope you answer then honestly and carefully, because The Prime Directive is quite clear on the matters that we are looking in to."

Harley Gresham looks at the Starfleet members with apprehension. Any evidence presented here could surely be used against the mining staff. "Our miners have been confined to quarters and not allowed to work. I want to know how long we will be detained, because we have to pay them whether they are working or not. And I want to remind you that Starfleet will not be receiving any more Pergium as long as the mining staff can't do their jobs."

Axel: hears the questions: "Well you all are detained until you understand the serious of what has happened. You have been breaching the Prime Directive with what you have been doing. Were you not aware of what has or is existing on the planet?"

Kat looks down at a PADD and looks up intermittently reading out aloud slowly and clearly "On advice of legal counsel I decline to answer that question and refer you to my legal representative without accepting or denying any or all of what you are stating or alluding to. This is in accordance with my rights as recognised by all of the major authorities represented here."

Johari: shaking his head as he looks across the room at their counsel. Thinking they are afraid to answer question cause they know they are guilty so they have to bring this counsel with them that seems not to be able to sit still. Looking over at Kat, "Did you not know that by keeping this artifact from Starfleet that you were breaking policy?"

Droikor looks sternly at the elder interrogator. "I was hoping we can resolve this in a civilised peaceful fashion, I still am, however your insinuation and false assumptions are leading us away from that. If I may remind you this isn't a court of law recognised by any authority here in fact its not a court of any kind! Nor is it subject to any military protocol, it cannot be as my clients are not members of your military. Therefore, I must ask why you have restrained my clients in your brig? What misguided beliefs do you rely on to support such illegal action hmmm?"

Hopkins looks at her notes, forming her questions. "The Prime Directive state that all parties involved in the breaking of the rules must be held for questioning so the Truth can be found out. That is why we are all here today. A few questions for you. Droiker. Are there any other parties involved in this operation, aside from Alabaster Mining Company? Where does the Alabaster Mining company receive it's funds from?"

Gresham taps his index finger on the table in annoyance. "As I said to the away team members on the planet, that rock formation that looks like a face was created by water running down the cave wall. There are many different erosion patterns like that all through the caves. There is no evidence that it was created by an intelligent life form. As for the crates themselves, I am not aware of where they came from and I certainly deny that the contents originated in the mining colony. There are certain elements common to every plant and rock on the planet, one of which is microscopic levels of Pergium. Were the crate artifacts scanned for Pergium?"

Axel looks at the so called lawyer. "We are not a military, we are a federation of many planets, civilizations." Looks over at the cadet and nods in agreement to the questions ignoring the Foreman's question for now.

Kat looks more nervous as the tensions seem to rise. Confers with counsel and after some nodding and muttering "I can and am willing to deliver the status report you were due to receive a few days ago if that will help?"

Johari looks around the room. "Until we get some straight answers and no monkey footing around about what you both really knew or hiding behind this so called lawyer, for all we may know it might be one of your crewmen. So for now sit back and give us the answers that we want to know or your crew can say confined and armed with my security and marine teams until you give us what we want to know. If you didn't keep the artifact from Starfleet we wouldn't be here today and everyone would be working and doing their jobs."

Droikor responds to the young lady's question directly. "Your rules do not apply in this region of space. Maybe within Federation space but not here. I have agreed my client may answer your question via her status report if that will so please you?"

Hopkins: Still looking down at her notes, she asks " Is it true, Director Alabaster McKenzie, you ordered the mining to continue after the crates were discovered? Why were your reports delayed?"

Gresham: "We have been brought here against our will and detained, without any formal charges being filed and without any meaningful evidence being presented. I am putting you people on notice right now that I plan to file a formal complaint with the Starfleet Judge Advocate General the very moment we are released."

Axel: nods at Harley. "By all means file a complaint. You folks are the ones who did not inform us when you found the artifact, or even bothered to stop your operations when you found out it was a planet which once held a civilization and might still do. Which is why we are detaining you and the crew until we get the answers we need so that you do not cause more trouble than needed."

Kat confers with Droikor before responding. "I was prepared to provide a status report when we met on Tcatn V so I am going to do just that. I'm sorry you didn't get Ishka's message. What the message said however was that we won't have the 100kg shipment of pergium for you this quarter and will need to ask for an extension of another 6 weeks to get it together for you. To explain, we've had a few 'distractions' here the last few months. As you may know we have two miners that have just disappeared. We're still trying to find out where they are but what with the searching and the concerns about whether it was an accident or something more sinister in the mine and the reluctance of the remaining team to work in a potentially unsafe environment, well it's all been difficult. The rest of my status report explains how we have re-allocated the resources rather than leave them idle, using them to investigate other deposits, the discovery of latinum, the search we have been undertaking for the mine, the discovery of the carving, our projections for future yields. I'm not sure though whether this isn't completely moot now if you don't want us to continue the mining operations now?

Johari looks over at this so called lawyer. "Sir, you might want to advise your clients to answer fully and honest to the best of their ability or we will be here all day and all night with no food or drinks. "

Droikor: On hearing the Nems interrogator, stands up slamming both hands on the table and raising his voice almost to a shout but maintaining a controlled tone "Mr Gresham is completely correct! Your illegal, and I stress that … illegal… detention of my clients will come to an end after this meeting has concluded. I have been very clear that I seek a peaceful resolution, but if that cannot be achieved in this meeting then my clients and I will be resuming our discussions with you from elsewhere next time, and my clients will certainly NOT be returning to your holding facilities, no matter how many times you threaten them with use of force! It really is quite preposterous that you should have put them there in the first place! So let's all be clear about that, unless it is your intention to actually use violent means to usurp my client's rights and continue your unlawful detention? Is that what you intend to do?"

Hopkins looks the Mining Foreman directly in the eye. "This is a fact-finding meeting. We are here to help you prove your innocence. *IF* you choose not to co-operate, we can assume you have something to hide, and will be forced to dig deeper into this situation, and who knows what we might find? Illicit funding? Safety protocols overlooked? I'm sure we could find something that doesn't look very good to the other companies that may want to employ you. Think about that, before you threaten us."

Gresham looks at the Doctor with annoyance. "Starfleet scanned this planet down to the last microbe before the company started mining operations. They found no life forms other than low level plant life. We have installed life scanners and run them weekly just to confirm that we aren't invading anyone's territory by digging mines. We never heard a beep out of any of those scanners. Granted, we did seem to lose track of two of our miners, but anyone is free to come and go as they please without notifying us. So it's obvious that there are no intelligent life forms on this planet other than us. Do you disagree?"

Axel: "How can we know there are not intelligent life there? There are plenty of different species out there, not all live by air and water or even show up as a lifesign on our scanners. But considering your finding you would think you folks would stop up, report right away. And to follow the regulations that you do know very well before you even started."

Kat: "I have provided you with the status report due" Looks down at a PADD and looks up intermittently reading out aloud slowly and clearly "On advice of legal counsel I decline to answer that question and refer you to my legal representative without accepting or denying any or all of what you are stating or alluding to. This is in accordance with my rights as recognised by all of the major authorities represented here."

Droikor straightens his tunic placing his PADD on the table and aiming at the open space at the end of the table "Let's deal with this question of life on the planet shall we? In order to do this let me tell you a little of ancient Ferengi history" Flicks on the PADD whereby an image is projected into the space. "This image is of the face you have seen on Tcatn V in the main mine cave, the carving that has changed all our views about what this planet means." Waits a few moments for everyone to recognise the image as that from the main cave. "A long time ago, and we're talking almost 10 thousand years ago, not long after Gint compiled the very first 'Rules of Acquisition'!" pauses with a slightly bowed head as a mark of reverence and respect. "Back then there was a famous Ferengi explorer of the name DaiMon Gralok. This legendary Ferengi explored and expanded the alliance all over the Alpha quadrant. He is thought to have been the first being from the alpha quadrant to have ever encountered the Borg, hence the low Borg species number assigned to the Ferengi. Species 5618 – Hewmons, Species 3259 – Vulcans, Species 6291 – Yridians, Species 8472.." pauses as if stuck for a moment "Well, yes Species 8472, but anyway Ferengi? Species 180. His exploits make up a good portion of our songs and stories, anyway suffice to say DaiMon Gralok is a highly significant part of Ferengi history. It was even rumoured he had travelled way out into the Delta quadrant, possibly as a result of his contact with the Borg." Leans forward and flicks the PADD placing a second image next to the first. "This is DaiMon Gralok. As you can see, the similarity is remarkable! I would go further and say the image you have found in the cave is indeed of DaiMon Gralok!" Takes his seat again. Quickly sits up halfway and adds "oh yes incidentally if you're interested in Gralok and Ferengi history I have several copies of an excellent summary available at an incredibly good price of 3 slips of gold pressed latinum, just see me after" smiles broadly as he sits back down.

Hopkins looks at her PADD, searching for reports of who the missing miners are, coming up with nothing. Looking more deeply into the prior reports, there seemed to have been unusually high accident rates a few weeks after mining operations began. "I can't seem to find the names of the Missing crewmen. Who were they, and what were their positions?"

Gresham smiles at the Doc. "If Starfleet believes that there are intelligent life forms on the planet, then please beam one up and we will interview him. I would be the last person in the galaxy to invade someone else's homeland and start stealing his resources. But so far all you folks have is a suspicion that someone else might be down there. That's pretty slim evidence to lock people up with." He checks his PADD quickly. "I don't have those names right now because workers seem to arrive and depart regularly, and we don't keep up to date records of everyone, just anyone who enters one of the mines. I will do some research and get back to you on that question."

Axel nods at the Foreman: "Please do, we need the names as soon as we can. And you should always keep up to date records of who is on the planet at all times."

Kat confers with counsel. "Ok I can answer your question there Ms Hopkins. The miners missing are Mr I. Mann a structural engineer and Ms F. Peabody who was responsible for the medical and catering provisions. However as far as I'm concerned they are all missing now as you have detained them!"

Johari: Going through his notes on his PADD as he looks over at Kat, "Why are you having crewmen just disappear and no trace of where they have gone? There must be more going on than you are leading us on about."

Droikor slides the PADD to one side clearing a space before him and looks directly at the group in turn. "Coming back to the important point before us. I do have to thank you for finding this artifact, and for your attempts to stop the mining activity and preserve this holy Ferengi site. Your laudable principles of respecting life and its independent un-interfered with development as enshrined in your 'Prime Directive'" grinds his teeth for a moment "whilst admittedly sometimes irritating when it gets in the way of Rule of acquisition number 45" before brightening "Is however on this occasion to be applauded. This is the furthest confirmed location of DaiMon Gralok's reach and I hereby lay claim to Tcatn V on behalf of the Ferengi Alliance and re-name Tcatn V 'Gralok's Reach' with innumerable thanks to our Federation allies for locating this treasure and returning it to its rightful owners!" Passes a document over the cleared space in the table "you will find notes of authority from the Ferengi council allowing me to speak on their behalf on this matter, signed by the Grand Negus himself no less!"

Hopkins looks across the table at the Foreman. "After discovering the crates, how long after did the miners go missing? How exhaustive was the search? Were their families notified? Did operations cease while the search was going on? Have you read their personal Logs to see what the last entry was?"

Gresham works with his PADD, moving names around and cross referencing times and dates. Then he scratches his head and looks up at the Cadet. "Like all mining operations, we track the names of people who enter and leave the mine. Here, it's just a formality, because as you can see, our mines don't go into the rock for more than a few feet. So, uh, we tracked entrances and exits, but no one really looked at the results until right now. My records show that two miners, Lara Chester and Joshua Crowder, entered mine shaft number six, three days ago, but never came out. We thought they had just had enough of mining here and moved on to somewhere else. But there's no record that they ever left the planet."

Axel hears his PADD beep requesting him to Sickbay for emergency "Please excuse me all. I hope you all will answer truthfully and give the needed information" looks at Nems and Pleasure and nods as he stands up and leaves.

Kat: Feels increasingly nervous and responsible as this seems to be spiraling way out of all reason. "Look let me try to explain" Being somewhat firm with counsel as he's only little anyway "When we first uncovered the carving, we didn't know what it was. Yes of course it struck us how could that be here on a planet with no native life and we naturally assumed it would have been made by visitors. There is no other evidence or suggestion of evidence on the entire planet that we have found to suggest a resident life form of any kind here ever. We didn't see it as important enough to report immediately however after it was recognised by the Frakit & Darnit representative we realised it was probably very important to the Ferengi so we included it in the report at the first opportunity. I really don't know why we're being held and I want to leave. It wasn't our intention to become involved with the fate of planets between major galactic powers!"

Johari: Nodding my head listening to Foreman Harley's answers, "Sir have you tried to figure out where they have gone or who is responsible to make them just disappear into thin air?" Listening to his combadge that their mining crew becoming impatient and demanding to be let out. Rolls his eyes as he listens to the Director in what she has to say. Looking over to the counsel thinking to himself there is still something fishy about him.

Droikor interjects almost before the final words leave Kat's lips "Yes well that as may be but whatever my client is saying albeit in a desire to help you understand the situation, is not in any way an admission of any wrong doing nor can it be used out of context, and it is also subject to revision as my client is under extreme duress here having been unlawfully confined to your brig and placed under quite unreasonable and intolerable stress!" shakes his head showing off his wonderfully defined lobes "Quite honestly I don't think she should be offering any information in her current state and until after she has rehabilitated from this brutish treatment." Reaches across and pours Kat a glass of water with a consoling touch.

Hopkins smiles. "Mr I. Mann, Ms F. Peabody, Ms Lara Chester and Mr Joshua Crowder. I seem to count four names there. It seems that is more than the two you first reported. What else are you hiding? Ms McKenzie, did anyone tell you to hide the names of the other two missing miners? Was it perhaps a Ferengi ?"

Gresham looks at his PADD again. "While it is true that two of the miners who were working for us went missing, that is an internal matter for the Alabaster Mining Colony and not the business of Starfleet. You may scan the planet for them if you like, and we would appreciate it, but this is not probable cause to hold us for questioning. Unless, of course, you believe that the company is at fault in some way. In which case you will need to bring out your evidence that a crime was committed. Oh, you have no evidence? Then you have no reason to detain us." He hears the other two names and looks at his PADD again. "Mann and Peabody? Well they are not...umm...yes they are, two employees not accounted for." He looks down at the table in embarrassment.

Kat: "I have provided you with the information you are entitled to, and will not be interrogated like this further!" Looks down at a PADD and looks up intermittently reading out aloud slowly and clearly "On advice of legal counsel I decline to answer that question and refer you to my legal representative without accepting or denying any or all of what you are stating or alluding to. This is in accordance with my rights as recognised by all of the major authorities represented here."

Johari: "Well that may be true and yes I have heard everything you have said I am just having a really bad gut feeling that something is still not right here. I have not put my hands on it. But as Vice Chief of Security I do not feel comfortable with just letting you go at this point."

Droikor: "I think we are done here, we will be leaving now"

Hopkins: "And let us report that the Ferengi will be will be claiming a planet with possible life forms, probably doing massive changes to the troposphere, and draining it of its elements? I'd rethink that plan, Droiker. The artifact is not proven to be of Ferengi origin, remember."

Gresham looks at the personnel employment records. "You know, Mann and Peabody were technically not miners, just contractors employed with the colony. They never entered any of the mines. So looking at strictly mine employees, I was not responsible for those two because I never tracked their whereabouts by procedure. Now as for letting us go, we put all of our money and time and effort into these mines. We will not be leaving the planet and the mines unguarded. Why, anyone could come in here and steal Pergium if we weren't around to stop them." He turns to glare at the Ferengi.

Kat feels her heart pounding and thumping in her skull as what appears to be a stand-off is reached. Rises to her feel a little shakily not sure what is happening or where she's supposed to go looking over at Droitkor and Harley with tears starting to form in her eyes.

Johari stands up as he guards the exit. "No one said anyone was dismissed." Looking over my PADD after speaking with Cadet Hopkins. "How do we know that you indeed are not the reason why these two miners have just disappeared?"

Droikor: "Dismissed? How can you dismiss non military exactly?" Smiles an 'I know something you don't know' kind of smile often found on the faces of the best lawyers in the heat of a moment, as he calmly and more softly speaks "Let's just get something straight shall we? There's no point wasting each other's valuable time" Taps into his PADD "Have your bridge crew scan these co-ordinates" passes a prewritten small manuscript over the table "While you are doing that let me tell you what you'll find freshly de-cloaked there. Before I do however may I remind you, and yes I do seem to be doing quite a lot of reminding you today don't I?" chuckles a little "As I was saying I will remind you that I want and still hope for a Civilised ….. Peaceful …. Dignified…. Sensible….. Lawful…. resolution to today's proceedings. I am sure really that you do too despite your threats of violence which I'm sure are just that, threats and no more. I have dealt with the Federation before, and it's not my opinion that you are an unlawful violent race. However just in case I am wrong …….. You will no doubt recognise the signs of a few ships which form our escort away from here. I am sure you will also correctly identify the warp signatures of those vessels and realise whilst it is unusual to have a group of D'Kora class Marauders as an escort…" pauses and scans the room "Let's just call them 'conscience peacekeepers' shall we? There to ensure I am right and you are not a violent, unlawful and to add to that list of attributes …. A foolish race!" Resumes his seat clearly feeling his point has been made and received quite clearly enough without having to explicitly resort to crude threats.

Hopkins looks to Ms McKenzie with her eyes open and wide, hoping they will be perceived as soft and understanding "Director, are you ok? Perhaps you'd like to tell us something? Are you afraid to do so because someone is threatening you? I can guarantee your safety, if that is the case. All you have to do is tell us what you know."

Gresham watches everyone standing up and wonders what's going on. Did he miss some silent signal? Then he catches the Ferengi lawyer's reference to a fleet of their ships. "A Ferengi fleet? Here? For what purpose? This is not what we agreed to! That's OUR Pergium down there." He stands up beside his chair. "At this time I am formally requesting asylum aboard this vessel due to the potential for becoming a prisoner of the Ferengis if they beam us out of here."

Kat: "The only people I feel threatened by are YOU for holding me here against my will for no lawful reason! I have had enough I am leaving with counsel whatever that takes! Harley you should come with us we're not prisoners its staying here that makes us prisoners!"

Johari taps his combadge, "This is LTJG Johari I repeat what ever you do, do not let the miners out of your sight, LTJG Johari out." Hearing the chatters come on his combadge as he listens. "No one said anyone was prisoners but there is something very fishy here and its not what I had for breakfast."

Droikor taps into his PADD again "You now have 10 minutes to release us for transport off this vessel otherwise it will no longer be myself you will find yourselves negotiating with but the DaiMon of that Ferengi fleet right there! Come with me Ms McKenzie Mr Gresham if you wish to end this charade now!"

Hopkins quickly confers with Lt. Johari. "Request for asylum granted, provided you tell us everything about your 'agreement' with the Ferengi."

Gresham looks at Kat, trying to evaluate whether she is under duress from the Ferengi lawyer. "The only thing keeping the Ferengi from stealing the Pergium was the presence of our colony. If we vacate and there are no company miners down there, then the planet becomes salvage and anyone can claim it." He looks directly at the Ferengi. "And believe me, anyone WILL claim it. No, I'm staying right here." Looks at the Cadet. "We may or may not have been selling SOME of our Pergium to the Ferengi Alliance in return for gold pressed latinum."

Kat looks sadly behind at the absence of Harley hearing his comments to the interrogators. Looking up at Droitkor "Can we please get out of here?"

Johari points to Cadet Hopkins. "Go take the other exit as I watch over this one."

Droikor consoles Ms McKenzie. "Do not concern yourself, you will be back on the mining colony sooner than you think with a greatly expanded brief including Pergium, latinum and a thriving tourist operation on 'Gralok's Reach."

Hopkins calls out "It's not too late to save this world, Director!"

Gresham walks over to the door, near the two Starfleet officers. "It's not illegal to sell Pergium. It belongs to us and we can sell it to whoever we like. The Federation is not at war with Ferenginar so we weren't aiding the enemy. But now that I am under your protection, maybe you'd better put me back in the brig for safekeeping."
