TDRP2236: "Order in the Court!" (220924)

The USS Taylorholic Durant is considered to be the Flagship of the UFS Fleet. We are honoured to have Admiral Mike Calhoun as our former CO and as a current crew member, as well as other luminaries. We are para-RPers and storytellers. Using live, in-the-moment chat, we listen, read, respond, and create a new story as a collective of writers jamming on a theme. We are given a context – a place to begin and then improvise together what happens next, and what happens after that… and where does that take us.
That sense of being in fellowship with other creative people who understand the overall context and environment while writing a story that is vibrant and alive creates a sense of enjoyment and togetherness. Our goal on Durant is to foster that sense of belonging, to embrace good RP etiquette, and to have tons of fun!

SITREP:

The hearing starts and Captain Evelyn Rieko, Captain Hal Jordan and Rear Admiral Cheryl Skinstad will all make their opening statements.
The hearing is to determine if the prime directive was violated by Lt. Colonel Elsa Mitchell, Lt. Sandra Lacrima, Lt. Selina Otsuka and Ensign Carol Ellsworth, and if they should be arrested and tried. RADM Skinstad will listen to all of the information given and the testimonies and she will decide the outcome.

Rear Admiral Cheryl Skinstad has returned to the USS Durant to sit as judge and hear the case of the alleged prime directive violations. Captain Evelyn Rieko and Admiral Zania Turner are the prosecution officers and Captain Hal Jordan is the defense counselor for the accused officers. The officers are accused of violating the prime directive while in Sector 009D on the Class M Planet, (now referred to as Planet D9428 and as the Priki Planet) by interacting with the primitive race on the planet and exposing them to advanced technology.

RP NARRATIVE

Evelyn Rieko walks into the Hearing Room and hears Ensign Carol Ellsworth speaking to Hal, but could not make out what was being said, and then silence fills the room. Evelyn nods to Hal and walks over to the accused officers and nods to them as well, and says, "Good morning everyone." She then walks over to Cheryl who has now taken her place in the judge's box. Rieko begins, "This hearing will come to order with opening statements. I speak on behalf of the Federation and Starfleet, with Rear Admiral Zania Turner assisting. I am here to ask the question, "Was the Prime Directive violated by these officers?" She waves toward the officers. "This is the basis of this hearing, and if so, was it done willfully without regard to the Prime Directive, which is one of the foundations of the Federation and Starfleet? It is my duty to put my personal feelings aside as your Commanding Officer and just take into consideration the facts of this case." She then walks over to Hal seated at the defense table, and continues. "We have as the Counselor for the accused, Captain Hal Jordan, an honored and decorated officer in UFS, he will be speaking on behalf of the accused officers who will also be referred to as witnesses going forth. He will start with his opening statement. The accused will all be sworn in at the same time, right now." She walks over to the accused box and says, "Raise your right hand, each of you. Do you Starfleet officers, Lieutenant Colonel Elsa Mitchell, Lieutenant Sandra Lacrima, Lieutenant Selina Otsuka, and Ensign Carol Ellsworth, hereby swear to tell the truth, the whole truth and nothing but the truth, in this case of possible violation of the Prime Directive? Staying firmly in your oath as a Starfleet Officer. If so, say 'Yes, I do swear'." She waits for the officers to swear before going on. "We are honored to have the honorable Rear Admiral Cheryl Skinstad, an honored and decorated Officer of United Federation Starfleet and former XO of the Durant. She is here to listen and lead the discussions. She will hear the testimonies today and will be relied upon to give the final decision at the end of these proceedings. You have the the floor, Admiral." She then walks to her table and sits.

Cheryl Skinstad looks to the Officers in the room and speaks: "As you have all been advised, I am Rear Admiral Cheryl Skinstad. I served on this very ship, the USS Taylorholic Durant, as XO. That was before most of you became crew members. It was a glorious time. I understand what it is like to find new planets, new scientific discoveries, new civilization, and charting areas of space that are unknown to us. It is a wonderful experience and pride to be a part of United Federation Starfleet. So you see, I am not so different from you all. I understand circumstances and situations that can happen when we are out there exploring, but make no mistake, I will uphold the principles of my oath to United Federation Starfleet. I will be fair and look at all sides of this situation of whether or not the Prime Directive was violated and together we can find the truth and a decision will be made. To clarify, the officers on the Hemmer shuttlecraft were in an ion storm and systems failing so they found the nearest Class M planet and crash landed there. The second shuttlercraft, the La Forge shuttle, went out as a search and rescue mission and found the officers and the Hemmer shuttle. They saw you crash from the sky, and you could not have prevented that. It has happened before. Most of the officers interacted with the tribe members. However they did not do this intentionally with the exception of preventing them from dying from radioactive sickness. I think this is the key issue for me."

Carol Ellsworth raises her hand as she is requested to, the Captain's words playing over and over. She gulped, she was swearing to tell the whole truth and nothing more. "Yes, I do swear." She moves slightly on her seat and continues listening to Admiral Skinstad. She clears her throat. "Yes, we were in an ion storm and we had to land on the planet, it wasn't intentional."

Selina Otsuka was thankful for Sandra's reassuring hand on her shoulder earlier as she feels her anxiety levels dropping slightly. She looks up as Captain Rieko begins her opening statement and absentmindedly dodges her Captain's wave towards what she thought was herself. Or perhaps the 4 of them. She nods as Admiral Skinstad's words sink in, yes she was sure that situations like what they have experienced would have happened to others before her. Yes, what followed after the crash may have violated Starfleet's Prime Directive. But... what distressed Selina most was not the prospect of being court martialed for that. What she was losing sleep over was the fact that her inability to control her crippled shuttle nearly caused the lives of 2 crew members. Those 2 who have entrusted their lives to herself... one lies in sick bay, fighting for his life and another she has not heard from since. Selina begins to twist the hem of her uniform skirt as the hearing continues.

Sandra Lacrima greeted Fleet Captain Rieko like the others did as the CO walked past the area where she was sitting with the three other crew members who were about to be questioned about the incidents on the unexplored class M planet. When told that they would be sworn in, she raised her right hand and replied as asked for. "Yes, I do swear,“ and lowered her hand again. She patiently, yet a bit nervously waited for the questions to be asked while she was listening to Rear Admiral Skinstad's opening speech. From her point of view, the hearing seemed to be just something mandatory and that everyone knew that it was just to follow Starfleet protocols. But who knew what they would come up with in the course of the interrogation?

Hal Jordan looked at Fleet Captain Rieko. "Good morning, Captain. We had a short preliminary discussion before the hearing convened. The shuttle's crash landing on the planet was accidental and unavoidable. The rescue shuttle's landing on the planet was also unavoidable due to the inability to use transporters to rescue the stranded crew members. Landing at that location was necessary because the first shuttle had severely injured crew members who could not be moved to an alternate location. The officers who made contact with the planet's natives did an admirable job of non-interference, preventing any contamination of the culture with ideas and concepts from outside. A lost phaser and the crashed shuttle were both recovered and removed from the planet, and no other technological items were left there. The only possible Prime Directive violation was the provision of medical care and advice to the natives. This was done not to interfere with the natural development of their society, but as a simple humanitarian gesture. The radiation in the caves was killing them. Their society would have been extinguished had they remained in the caves."

Zania Turner stands behind the desk and announces, "Your honor, Fleet Captain Rieko has asked me here as an assistant and counselor. Violations of the Prime Directive are very serious offenses as the repercussions can be far reaching and have a severe impact on the natural development of the pre-Warp civilizations that are exposed to Starfleet technology, advanced knowledge of medicines, and ideals. It is our hope that we can not only get to the bottom of this, but also make sure that such violations do not happen again."

Elsa Mitchell: "I do swear." Then she starts a quick statement: "I as Officer in charge of the search team do accept the facts that we had landed on a planet of a pre-warp civilization. The Lieutenant and I had not known at the time and had put risk aside to save our lost crew mates. The facts we had faced upon arrival were that two Ensigns were facing life or death. As a high ranking Officer of UFS and the Officer in charge there, my duty was to ensure the lives of all involved and all life on the planet."

Gunnar Ragnarsson shakes his head and says, "I'm sorry Lieutenant, but we're not quite to the point of returning you to duty yet. I believe I know what is causing you issues, but we need to look at ways to treat it first. I believe you are suffering from Af-Kelt. Are you familiar with the condition? Unfortunately we don't have a lot of information on it in Federation databases. I have reviewed your records, and the previous doctor mentions some similar symptoms stemming from a possible temporal incident. Is there anything you can tell me about that? It might help us as far as how to move forward from here." As he waits for what Ginrai has to say his thoughts roam to his crew mates in another part of the ship going through a hearing. He really doesn't know anyone yet as he's still very new to the ship, but nonetheless he's still concerned for their well-being. Who wouldn't be? A Prime Directive violation is a serious deal. He hopes everything turns out okay for his crew mates.

Ginrai Yamabushi takes a deep breath and sighs, looking down at the duty reports and hearing the news was like a hard blow to him. He looks up as he is asked about Af-Kelt and nods, "Yeah, I've heard of it... never thought at all I'd ever deal with it, but here we are." He chuckles, as he hears the doctor ask about what it's like, he replies, "Have you ever heard a song played out of tune? Or a familiar dish that you've had and it's disgusting? That's what Af-Kelt is like...only worse." He then hears the next question, "As far as that is concerned... it's classified." He raises his hands as a shield, "I can't say any more about it."

Rieko nodded as she listened to Cheryl's opening statement. It was true, there were many wonderful adventures Cheryl had shared with some of the older crew members on the Durant, and at times they were close to violation of the Prime Directive themselves. Her mind drifted to a mission on the planet Nadeu, and the Nadeu people with a caste system that caused the race to mistreat those at the bottom of their social system. Her mind went back to that time when the Durant away team came very close to violating the Prime Directive and maybe we actually did violate it by interfering in the social structure that was to us unjust and actually cruel. The Nadeu, a warp capable race, yes, but they did not allow any outsiders onto their planet, until a drought happened on the planet and many died. Then they requested help from the Federation. We helped them with a concept they already had in place to end the drought. They were warp capable so that was all fine, but where we interfered was with the mistreatment of the ones called the Octics. One was sentenced to death just because he entered a 'pristine' building to speak with the Starfleet Officers. She shook her head, and focused on what was happening now, she would look back on previous similar cases later. She listened to Hal's opening statement and then to Zania's. She stood and walked to Cheryl, standing in front of the judge’s box, and gave her statement, “ I am representing the Federation and Starfleet along with Rear Admiral Turner. The reason for this hearing is to determine if the prime directive was violated willfully without regard for what it stands for, and should these officers be prosecuted? As stated by the defense the fact that the Starfleet Officers were seen by the primitive inhabitants of the planet was unavoidable, but did the officers decide to interact with the natives and tell them about advanced medicines, and tell them about the Federation? Did the officers interfere with the society structure and development of the tribe?  Did the officers disregard the prime directive? Then standing near the witness box she said, "I call to the witness stand Ensign Carol Ellsworth. Ensign, please be seated." She watched as the Ensign sat there and continued. "Ensign Ellsworth, my first question to you is do you understand the Prime Directive? Tell us what it means to you."

Skinstad listens intently to everyone's statements.

Ellsworth froze on her seat as she listened to Admiral Turner. She would need to take a picture of the 4 looking guilty and hang it on every mission to remember why they shouldn't interfere. She bit her lip slightly, they were right though. Lieutenant Colonel Mitchell's words had calmed her a bit. That was a duty too, to ensure the planet's and the crew's life. She had stopped tapping her feet, relaxing a bit but then she had been called to the witness stand. She stood up slowly and breathed deeply, raising her head. She was guilty but she wasn't. The stress of the moment made her strong to face the facts. She wasn't ashamed of what she had done. She looked at Captain Rieko and nodded "Yes Captain Rieko. I understand what the Prime Directive means. The Prime Directive prohibits Starfleet personnel from interfering in the development of any society to avoid external influence so we don't alter their society, culture, religion and development.

Otsuka nods "Yes, I do swear" as she tries to calm her wandering thoughts to the critically injured Torak. She listens to Captain Rieko's and Ensign Ellsworth's exchange intently.

Lacrima laid back in her chair and followed the hearing and the testimony of Ensign Ellsworth. This gave her the chance to prepare her own statement when most probably asked the same questions.

Jordan listened as Ensign Ellsworth responded to the prosecutorial question. He scribbled some notes on his PADD, preparing for cross examination if necessary.

Turner sat down behind the desk to listen to the testimony, interested in what was being said.

Mitchell looks to all of the officers who stand on trial for violating the Prime Directive. Earlier, she had assured them that everything will be okay, and to tell the truth. She also said that she will accept any punishment the court will hand out. As the officer in charge, it falls on me to ensure that no violations were caused.

Ragnarsson nods at the classified comment, having expected something to that effect when it comes to temporal events. There's not much Gunnar can argue with him on that. Nonetheless, he had to figure out a treatment for Ginrai. "Of course Lieutenant. I wouldn't dream of you violating any confidentiality." Ragnarsson continues. "Unfortunately for us, there hasn't been established a good treatment for Af-Kelt, other than time, so here's what we're going to do. I will release you from sickbay. However, I don't feel you are ready to be returned to full duty yet. Not when you're still experiencing symptoms. So I am listing you for light duty only at this time." Ragnarsson adds, "Moreover, if you experience any more incidents of confusion or nausea, you are to report to sickbay immediately and I will give you a hypo to assist with that. Let's get together one week from today for a follow up appointment. If you're showing improvement and the symptoms aren't happening as often, then I will consider returning you to full duty." Ragnarsson makes some notes on his PADD in Ginrai's medical file before giving the Lieutenant a mock stern look. "Please do not let me hear about you crawling around in any Jefferies tubes during your light duty, or I'll have Security drag you back down here." He trades the stern look for a smile. "Office work only, please."

Yamabushi takes a deep breath, as he looks down at the ground. "Working from the seat of a desk..." he nods, "Got it... " he says with a little bit of sarcasm, "Well... it could be worse..." he grabs his now turned off PADD and taps it on his thigh, "I could be down here." He stands up, and smiles, "You got it Doc," he smiles letting out a little bit of secrecy. "Wouldn't be my first run-in with Security, and trust me... I'm in no condition to be dragged back here." He continues to chuckle.

Rieko nods as she listens to Carol's response, impressed with the Ensign, and says, "Ensign Ellsworth, that is an excellent definition of the Prime Directive. Now, tell us how you interacted with the Priki tribe now that you have shown us you fully understand the meaning and importance of the Prime Directive, and do you feel you violated it?"

Ellsworth had heard Lieutenant Colonel Mitchell's words. She wouldn't let her take the blame. Then Captain Rieko asked the next question, oh God, this was a serious question. She was silent for a moment, the question had made her remember what had happened there. Like small taps on her forehead, the flashback invaded her. 

Ellsworth: (FLASHBACK) She approached Una and checked on her medical condition before trying to make her swallow the medicine. She couldn't use other methods and it was important that Ahnee saw she was giving the medicine like they would, as if Una didn't respond to the treatment Ahnee would have to give them the medicine. She had been insisting with the story of the sky. She waved her hand, inviting Ahnee to come closer, and pointed to an invisible point on the planet. "We come from the other side of the planet." "Many years to find you." She smiled softly and pointed to the sky "Big mountains, frozen water. Ice". She lowered her eyes, knowing she was omitting a big part of the truth, but it was needed. "We need to go, family waits." She walked slowly to the top of the hill. She had been working secretly with some stones she had found there, similar to alexandrites, they could change colour according to the temperature and lighting. It was very rare to find in the universe, even here was just good luck to find it. She had read somewhere that some ancient legends mentioned similar stones that would change to green if they detected poison in the surroundings. She didn't know, but it was worth a try. She would remember Ahnee's lovely gesture to give her the necklace, she had spent many hours working on her own necklace so the stone would fit. She was happy with the new necklace, it was just a chemical trick but it seemed like it had fire dancing inside the stones and it would change to other colours if the temperature was too low or too high. Ahnee would learn that. Ahnee had followed her and when they were on the top of the hill, she grabbed Ahnee's hand and placed the necklace between her hands. "I hope you remember us. Don't try to find us, only a child would survive. Sagundi could be offended if you painted the walls, but this gemstone will help you to remember the tribe that came from afar. You have helped us. We'll help you to find another home."

Ellsworth: The flashback ended as the silence had invaded the room. Her face reddened and she uncrossed her legs, squirming in her seat. She had been silent for a moment. "We were exploring the nebula and when the ion storm trapped us we had to land on the planet. The tribe members saw us and approached. They started trying to heal Ensign Torak. Our medical officer was hurt too, Ensign Linda. They offered to take us to the caves. We couldn't communicate with them as their language wasn't recognised but slowly both started understanding each other. I ignore what happened when the prehistoric bird kidnapped me but I do know they left their home to rescue me. When I got back to the caves many of them were seriously ill, due to radiation and one of them, Vrook, had lost a lot of blood so I administered some drugs with the hypospray and scanned him. They asked for our help to heal the others, so I mixed some herbs and minerals, basically we used our advanced knowledge to help them with a natural potion. Vrook, the tribeman we helped, wouldn't be hurt if it wasn't because of our presence there. It was a way to return things to normal. My phaser was lost too but it was recovered. I also told them we were from the other side of the planet. I fully understand that interaction with pre-warp civilisations is against the Prime Directive and the consequences can be devastating."

Skinstad waits for everyone in turn to answer Fleet Captain Rieko before she requests to ask a question to all the Officers involved in the Hearing.

Otsuka looks up to Ensign Ellsworth as she relates what happened on the planet, similar to what Selina encountered. Her mind wanders off to play back the procedures she has taken on the shuttle and whether she could have done something different that would bring about a different outcome. Perhaps they might not have crashed.

Lacrima half-listened to the questioning and sank lower in her chair, with her thoughts drifting off as usual. She looked up to the ceiling, then to the corner where the questioning was happening, then her gaze wandered around the room to study what the other officers present were doing.

Jordan looked at the witnesses, Starfleet officers all, competent and unafraid. Academy classes on the Prime Directive were all standardized, so everyone had had the same training on the subject for many years. He was confident that they would all do well on the witness stand and this matter would be wrapped up fairly quickly. The cavemen on the caveman planet were too primitive to understand the concept of other worlds and space travel, and just to be safe, the crew members had not told them anything about their origin or their society. Unless something startling happened, they were all safe from disciplinary action.

Ragnarsson smiles and nods to Ginrai. "Very well Lieutenant. You take care and unless something comes up, I will see you in a week." He moves away to the nearest office and quickly types up a report, thinking he may run over to the hearing room and see how that is going.

Yamabushi sighs as he looks at the Doctor. He picks up his PADD and begins to walk towards the door. He starts working on the duty roster with disgust.
